Fuel AI, LLC ("Fuel AI," "we," "our," or "us") values the privacy of individuals who use our website, platform, and related services (collectively, the "Services"). This Privacy Policy explains how we collect, use, disclose, and protect personal information from users of our Services.

Your use of our Services is also subject to our Terms of Service.

1. Role of Fuel AI

Fuel AI may act as a processor or service provider when we process personal information on behalf of our customers. Our customers are responsible for determining how they collect, use, and disclose personal information through their own businesses and workflows. If you have questions about how a Fuel AI customer uses your personal information, please contact that customer directly.

Where you have executed an Order Form with Fuel AI, the Order Form controls in the event of any conflict with this Privacy Policy with respect to the specific services and terms covered by that Order Form.

This Policy does not apply to personal information about current or former Fuel AI employees, job candidates, or contractors.

2. Information We Collect

2.1 Information You Provide to Us

When you register for an account, enroll in active development, request a demo, contact us, or use our Services, we may collect personal information such as your name, email address, phone number, job title, company name, billing information, communications with us, survey responses, and feedback.

2.2 Information We Collect Automatically

When you use our Services, we may collect information about your device and usage, including IP address, browser type, operating system, general location inferred from IP address, features accessed, actions taken, pages viewed, dates and times of use, and other diagnostic or analytics information.

2.3 Information from Third Parties and Integrations

If you connect third-party tools or platforms to the Service, we may receive data from those platforms in accordance with your authorization. If you register using a third-party account such as Google or Microsoft, we may receive information such as your name, profile picture, and email address from that provider.

2.4 AI Interaction Data

When you use Fuel AI's AI-powered features, we may process prompts, inputs, queries, instructions, connected data, and AI-generated outputs as necessary to provide and improve the Service. For personalization features specifically, see Section 8A below.

3. Information We Do Not Intentionally Collect

The Service is not designed to process certain categories of sensitive information unless Fuel AI has expressly agreed in writing to accommodate such data. You should not submit payment card data, personal data of children under 13, government-issued identification numbers, or regulated financial information unless a separate written agreement authorizes that processing.

Protected health information (PHI) as defined under HIPAA must not be submitted to the Service. The Service is not designed, configured, or authorized to receive or process PHI, and Fuel AI does not act as a HIPAA business associate or provide a Business Associate Agreement under this Policy or our standard Terms of Service. Healthcare and PHI use cases require a separate written agreement; see Section 8B.

4. How We Use Information

We may use personal information to:

  • Create, maintain, and authenticate accounts;
  • Provide, operate, maintain, debug, and improve the Services;
  • Provide onboarding, implementation, and customer support;
  • Communicate about accounts, updates, support requests, demos, and requested information;
  • Send marketing communications where permitted by law and your preferences;
  • Analyze usage and improve features, workflows, and performance;
  • Protect the security and integrity of the Services;
  • Process payments and manage billing;
  • Facilitate third-party integrations at your direction; and
  • Comply with applicable laws, enforce our Terms of Service, and protect our legal rights.

5. SMS and Mobile Messaging Privacy

If you provide your mobile phone number or consent to receive SMS or other mobile messages from Fuel AI, we will use that information only to send the messages you requested or otherwise consented to receive, including service, account, support, onboarding, product, appointment, demo-related, and promotional messages where applicable. Consent is obtained through an affirmative opt-in process before any SMS message is sent. Consent to receive marketing messages is not a condition of purchasing any goods or services.

We do not sell, rent, or share mobile phone numbers, SMS opt-in data, or SMS consent status with third parties or affiliates for their marketing or promotional purposes.

Mobile information may be shared with service providers only as necessary to deliver messaging services on our behalf, subject to contractual restrictions that prohibit those providers from using mobile data for any purpose other than message delivery.

Fuel AI's platform also enables clients to send SMS, MMS, email, and voicemail drop communications to their own contacts and prospects through the Service. For these outbound communications, Fuel AI acts as a service provider processing contact data on behalf of its clients. Fuel AI's clients are responsible for obtaining required consent from their contacts before sending outbound messages through the Service. Recipients of client-initiated messages who have questions about how their data is used should contact the company that sent the message directly. Recipients may opt out of further messages by replying STOP.

You may opt out of SMS messages from Fuel AI by replying STOP. You may request help by replying HELP or contacting us at support@fuelai.com. Message frequency varies. Message and data rates may apply.

6. How We Share Information

We do not sell or rent your personal information. We may share personal information as described below.

6.1 Service Providers and Subprocessors

We may share personal information with vendors, service providers, and subprocessors who perform services on our behalf and require access to information to provide those services. These may include cloud hosting providers, AI infrastructure providers, payment processors, communications tools, analytics providers, customer support tools, security tools, and authentication providers.

These service providers are authorized to use personal information only as necessary to provide services to Fuel AI and are subject to contractual restrictions prohibiting any other use.

6.2 Legal Requirements and Safety

We may disclose personal information if we believe doing so is required or appropriate to comply with applicable law, regulation, lawful requests, legal process, or to protect the rights, property, or safety of Fuel AI, our users, or others.

6.3 Business Transfers

If Fuel AI is involved in a merger, acquisition, financing, reorganization, bankruptcy, asset sale, or similar transaction, personal information may be transferred as part of that transaction. We will provide notice before personal information is transferred and becomes subject to a different privacy policy.

6.4 Aggregated or De-identified Data

We may disclose aggregated or de-identified information that cannot reasonably be used to identify you for business, research, analytics, or service improvement purposes. We do not permit any third party to attempt to re-identify de-identified data.

7. Cookies and Tracking Technologies

We and our third-party partners may use cookies, pixel tags, and similar technologies to operate and improve the Services, remember preferences, understand user behavior, and analyze performance. You can control cookies through your browser settings, but disabling cookies may affect certain Service features.

8. AI-Specific Data Practices

Fuel AI's Services are powered by artificial intelligence. When you use AI-powered features, your inputs and outputs may be processed by our AI infrastructure providers as necessary to generate responses and deliver the Service. These providers are subject to contractual data protection obligations.

Fuel AI does not use your Customer Data, Contact data, conversation history, or message content to train, fine-tune, or improve underlying AI models in a way that identifies you or exposes your content to other users. In anonymized, aggregated, non-identifiable form, usage patterns may inform general improvements to Fuel AI's platform capabilities.

For Fuel AI's personalization features — including writing-sample upload, optional third-party personalization integrations, and personality assessment — please see Section 8A below, which describes how that data is collected, used, and controlled in detail.

AI-generated outputs may be inaccurate, incomplete, or inappropriate for your specific use case. You are responsible for reviewing and validating outputs before acting on them. AI outputs do not constitute legal, financial, compliance, medical, or other professional advice.

8A. Personalization Features and AI Model Data

Fuel AI offers optional personalization features that build a personal AI communication model for each user ("Your Model"). These features are entirely optional and can be activated or deactivated independently at any time from your account personalization settings.

8A.1 How Personalization Works

When you activate a personalization feature, Fuel AI uses the data from that source — together with your consent — to build and continuously refine a personal AI model that learns your individual writing style, tone, vocabulary, and communication patterns. Your Model is used solely within the Fuel AI platform to generate content that sounds authentically like you.

Your Model is personal to you. The underlying data you provide is never shared with other users, your employer, or third parties in a form that identifies you or your communications.

In anonymized, aggregated, non-identifiable form, usage patterns across the platform may contribute to general improvements to Fuel AI's AI capabilities. This processing never exposes your individual content, identity, or communications style to any other user or party.

8A.2 Optional Features and Data Sources

Each of the following features requires your individual consent before activation. Consent is collected through an in-app modal that appears the first time you activate each feature. You may activate or deactivate each feature independently.

Email and Document Upload

When you activate email and document personalization, Fuel AI collects writing style, tone, vocabulary, and communication patterns extracted from your uploaded or connected emails and documents; metadata including approximate date range and volume of content analyzed; and, if you maintain a live email connection, ongoing patterns as your style evolves. This data is used to train Your Model to generate content in your authentic voice.

Fuel AI does not store the full content of your emails or documents beyond what is necessary to extract style and pattern data.

Third-Party Personalization Integration

When you activate an optional third-party personalization integration, Fuel AI receives a behavioral or communication-style profile from that provider, which may include personality framework scores such as DISC or OCEAN, communication preferences, decision-making style, and interpersonal tendencies. This data is used to enhance Your Model's ability to generate contextually appropriate content.

Any such integration is provided by a separate company with its own privacy policy. By enabling the integration, you authorize Fuel AI to receive your profile data from that provider, and you should review that provider's privacy policy independently. Fuel AI's agreements with such providers prohibit use of their data for any purpose other than building Your Model.

Personality Assessment

When you activate the personality assessment feature, Fuel AI collects your assessment responses and trait scores, inferences about your communication and interpersonal style drawn from those results, and assessment metadata including completion date and version. Personality assessment data is treated as sensitive personal data and is subject to heightened security and access controls.

Your raw personality assessment scores are never visible to your employer or other users. Fuel AI does not use personality data for any employment-related evaluation or decision.

8A.3 Consent and Control

Before activating any personalization feature for the first time, you will be presented with a consent modal specific to that feature. The modal describes exactly what data is collected and how it is used, and requires you to affirmatively confirm each data element before proceeding. You may decline consent and the feature will remain off. Your consent is logged with a timestamp associated with your account.

You may turn off any personalization feature at any time from your account settings. Turning a feature off pauses data collection for that source. Your existing model is preserved and will resume updating if you turn the feature back on.

To request deletion of data from a specific personalization source — such as removing email data while retaining your personality assessment data — contact privacy@fuelai.com. Note that deletion of a data source will require rebuilding the affected elements of Your Model without that data.

8A.4 Employer Access

Your employer, if they have purchased your seat, may access AI-generated outputs produced by Your Model. Your employer does not have access to your underlying personalization data — including uploaded writing samples, third-party integration profiles, or personality assessment results.

If you leave your employer, your employer's access to Your Model terminates immediately upon notification to Fuel AI at privacy@fuelai.com or deactivation of your seat, whichever comes first. Fuel AI will confirm termination of employer access within two business days of receiving notice. Previously generated content produced during your active employment remains the property of your employer. No new content may be generated using Your Model on behalf of your former employer after termination of access.

8A.5 Model Retention and Deletion

Your Model and associated personalization data are retained for the duration of your active subscription. Following the end of your subscription — whether through cancellation, expiration, or account closure — Your Model and personalization data are retained for thirty (30) days. During this period you may contact Fuel AI to arrange continued access. After thirty (30) days, Your Model and all associated personalization data are permanently deleted. Fuel AI will send a deletion notice to your registered email address prior to scheduled deletion.

To request full deletion of Your Model and all personalization data, contact privacy@fuelai.com. Deletion requests are processed within thirty (30) days of verification.

8B. Healthcare Use and Consumer Health Data

Healthcare and PHI

The Service is intended for businesses that are not HIPAA covered entities with respect to their use of the Service. Protected health information (PHI) as defined under HIPAA must not be submitted to the Service. Fuel AI does not provide a Business Associate Agreement and does not process PHI as a business associate under this Policy or our standard Terms of Service. Fuel AI may suspend or terminate access if it reasonably determines that a client is a covered entity with respect to its use of the Service or that PHI has been submitted. Healthcare and PHI use cases require a separate written agreement; contact legal@fuelai.com.

Consumer Health Data

When Fuel AI's clients use the Service to communicate with their own contacts, those contacts may voluntarily provide health-related information — for example, when inquiring about or scheduling services. Such information may constitute "consumer health data" under state laws including the Washington My Health My Data Act, Nevada SB 370, and similar laws.

With respect to consumer health data processed through the Service on behalf of a client, Fuel AI acts solely as a processor or service provider: we process it only to provide the Service and on the client's documented instructions, we do not sell it, and we do not use it for our own purposes. The client is the controller of that data and is responsible for providing any legally required notices to its contacts, obtaining any legally required consents, maintaining any required consumer health data privacy policy, and honoring applicable consumer rights requests.

If you received a message sent through the Service and have questions about your health-related information or wish to exercise consumer health data rights, please contact the client that sent the message. Fuel AI will provide reasonable assistance to its clients in responding to verified consumer rights requests. To the extent Fuel AI collects consumer health data as a controller in its own right — for example, through our own website — we handle that data in accordance with this Policy and applicable law.

9. Data Retention

We retain personal information for as long as necessary to provide the Services and fulfill the purposes described in this Privacy Policy, unless a longer retention period is required by law. For active accounts, we retain personal information for the duration of the subscription or subscription term.

Following termination of a subscription or account, we retain Contact data, conversation history, and message content for up to ninety (90) days to allow for data retrieval requests, comply with legal obligations, resolve disputes, and enforce agreements. After 90 days, this data is deleted except where longer retention is required by applicable law. Personalization model data is retained for 30 days following subscription end per Section 8A.5.

You may request deletion of personal information by contacting us at privacy@fuelai.com. We will respond to verified deletion requests within the timeframes required by applicable law. Fuel AI will provide written confirmation of deletion upon your written request.

10. Security

Fuel AI implements commercially reasonable technical and organizational measures designed to protect personal information. These measures may include access controls, audit logging, internal policies, employee security practices, and incident response procedures.

No method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security. In the event of a security incident that has resulted in, or is reasonably likely to result in, unauthorized access to personal information, we will notify affected individuals and customers within 72 hours of becoming aware of the incident, as required by applicable law. Notification will include the nature of the incident, categories of data affected, and steps Fuel AI is taking to address it.

11. Children's Privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without appropriate consent, we will take steps to delete that information. If you believe we have collected information about a child under 13, please contact us at privacy@fuelai.com.

12. Your Privacy Rights

Depending on your location and applicable law, you may have rights to access, correct, delete, restrict, object to, or request portability of your personal information. You may also have the right to withdraw consent where processing is based on consent.

To exercise privacy rights, contact us at privacy@fuelai.com. We may need to verify your identity before processing your request. We will respond within the timeframes required by applicable law.

13. California Privacy Rights

If you are a California resident, California privacy laws may provide you with additional rights regarding your personal information, subject to certain limitations. These rights may include the right to know what personal information we collect, use, disclose, sell, or share; the right to delete personal information; the right to correct inaccurate information; the right to opt out of sale or sharing where applicable; and the right not to be discriminated against for exercising privacy rights.

Fuel AI does not sell mobile phone numbers, SMS opt-in data, or SMS consent status.

14. International Users

Our Services are operated from the United States. Data is stored and processed in the United States. If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States. Where required by applicable law, we will implement appropriate safeguards for international transfers of personal information.

15. Updates to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or Services. The updated version will be identified by the revised Effective Date at the top of this Policy.

For material changes, we may notify you by email, within the Service, or by posting a prominent notice. Your continued use of the Services after the effective date of any update constitutes acceptance of the revised Policy.
